Membership Agreement
1. MEMBERSHIP TERM:
The membership term is indefinite and will not end automatically after the minimum membership term is over.
2. MEMBERSHIP CANCELLATION:
The membership can be cancelled anytime, without any extra fees or penatlies by sending an email to:
[email protected] or calling a mobile number: +44 7864 644622 / +44 7864 644628.
3. MEMBERSHIP FEES:
The Member and/or his/her parent/guardian shall pay HAKI CLUB, the Sports and Health Organisation a monthly or weekly membership fee. Membership fees are payable in advance on a monthly or weekly basis, and are non-refundable and non-transferable.
The membership fee does not include fees for the National, European or World Kyokushin Karate Organisations, which must be paid separately in addition to regular membership fees during tournaments, championships, belt grading examinations, etc.
Extra fees should be expected if the member wishes to participate in official competitions and belt grading examinations, special events, or extra training sessions.
4. PAYMENT AUTHORIZATION:
The Member and/or his/her parent/guardian authorizes the sports and health organisation to charge the Member's and/or his/her parent’s/guardian’s credit/debit card or other approved payment method for all membership fees and other charges incurred by the Member in connection with this Agreement.
The Member and/or his/her parent/guardian agrees to provide the sports and health organisation with updated credit/debit card or payment information promptly in the event of any changes. In cases when updates are not provided and payments are late, the Member and/or his/her parent/guardian shall assume all risks and will need to settle late payment fines.
5. PAYMENT TERMS:
The Member and/or his/her parent/guardian agrees to pay monthly or weekly membership fees to the sports and health organisation, regardless of the absence/missed number of training sessions no matter the circumstances.
The Member and/or his/her parent/guardian acknowledges and agrees that monthly or weekly membership fees must be paid promptly on or before the due date specified by the sports and health organisation.
The Member and/or his/her parent/guardian acknowledges and agrees that failure to pay monthly membership fees by the due date three times in a row may result in the suspension or termination of the membership and a fine of one (1) month’s membership fee.
There will be no fines or suspensions if the member sends an email to: [email protected] or calls a mobile number: +44 7864 644622 / +44 7864 644628 and informs HAKI CLUB about their difficulties to pay the membership fee. In this case, a specific payment plan or payment reduction will be offered to the Member and/or his/her guardian.
The Member and/or his/her parent/guardian acknowledges and agrees that any fines imposed by the sports and health organisation must be paid promptly and that failure to pay such fines may result in the termination of the membership and legal action taken against them to resolve any unsettled/disputed payments.
The Member and/or his/her parent/guardian agrees to pay any outstanding balances owed to the sports and health organization prior to termination, including any fees or fines related to missed payments or damages caused by the Member.
If the Member and/or his/her parent/guardian violates any of the rules or regulations set forth by the sports and health organisation, including but not limited to conduct violations or failure to abide by payment schedules, the sports and health organisation reserves the right to terminate the member's membership with immediate effect, with no refunds.
6. PERSONAL DATA PROTECTION:
All personal data shall be protected and used only for HAKI CLUB, Sports and Health Organisation’s management, i.e. only to track payments, contact Members and/or their parents/guardians, or build sports and health communities between Members and/or their parents/guardians that wish to exchange contacts and participate in public or online conversations.
Personal information will never be sold, traded or revealed to third parties unless the Member and/or his/her parent/guardian is wanted/requested by the official authorities for a committed crime or involvement in a criminal case, or is in some kind of a life-threatening emergency.
HAKI CLUB, Sports and Health Organisation shall reveal personal information to appropriate legal financial institutions and legal authorities if the Member and/or his/her parent/guardian fails to settle membership and/or other incurred fees and refuses to settle on a payment plan peacefully, or keeps breaking payment agreements.
7. MEDIA:
The Member and/or his/her parent/guardian agrees to allow HAKI CLUB and their partners to photograph, film, and post images, mention their name publicly online on various social medial platform or in news/sports articles, etc. for the purposes of promoting the sports and health organisation.
The Member and/or his/her parent/guardian acknowledges that:
• the images and all media content may be posted on the sports organisation’s website, social media platforms, newsletters, brochures, and other promotional materials;
• the sports and health organisation has the right to edit and use the images and content for promotional purposes in digital and paper forms;
• the sports and health organisation is not liable for any damages or claims arising out of the use of the images and content in accordance with this contract.
The Member and/or his/her parent/guardian may revoke their consent at any time by providing a written notice to HAKI CLUB.
8. MEDIA CONFIDENTIALITY:
The Member and/or his/her parent/guardian agrees not to publish any photographs or filmed videos of training sessions publicly online or share with anyone else without permission from HAKI CLUB, Sports and Health Organisation.
The Member and/or his/her parent/guardian acknowledges that:
• the sports and health organisation has the right to control the use of its name, logo, and other identifying information, such as the images and content related to HAKI CLUB in order to protect its image, brand, methods of operation, professional teaching and training techniques, etc.;
• any violation of this contract may result in legal action taken by the sports and health organisation to protect its rights;
The Member and/or his/her parent/guardian may request permission from the sports and health organisation to publish or share photographs or filmed videos of training sessions by making a written request.
The Member and/or his/her parent/guardian acknowledges that any disputes arising out of or related to this contract shall be resolved through arbitration in accordance with the rules of the relevant arbitration institution. Judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
9. PARTICIPATION IN HAKI CLUB ACTIVITIES:
The Member and/or his/her parent/guardian agrees to purchase the necessary protective equipment for their participation in the sports activities organised by the sports and health organisation and agrees to pay for the protective equipment purchased from the designated supplier(s) provided by the sports and health organisation in a timely manner. This includes but is not limited to martial arts uniforms, protective gear, and equipment required for specific sports activities, tournaments, examinations, etc.
The sports and health organisation shall provide a list of required protective equipment for each sports activity to the member. The member is responsible for purchasing the equipment from the designated supplier(s) provided by the sports and health organisation, and paying in a timely manner.
The Member and/or his/her parent/guardian acknowledges that failure to purchase or maintain the necessary protective equipment may result in their exclusion from participation in sports activities organised by the sports and health organisation, including official tournaments, examinations, training camps, etc.
The refusal to purchase official uniform and gear shall exclude them from participating in tournaments and belt grading examinations.
The Member and/or his/her parent/guardian agrees to inspect their protective equipment before each use and to immediately replace any equipment that is damaged or no longer fit for its intended use/purpose. The Member and/or his/her parent/guardian acknowledges that HAKI CLUB is not liable for any injuries or damages resulting from the use of defective or improperly maintained protective equipment by the member.
10. CODE OF CONDUCT:
The Member agrees to:
• abide by all rules and regulations of HAKI CLUB during classes and events;
• follow all safety rules and regulations of the sports and health organisation and follow instructions of the coach, sports teacher, and/or trainer;
• attend training sessions to the best of their abilities;
• wear the required uniform and equipment during all classes and events;
• arrive at each class and event on time and in appropriate physical and mental condition to participate in martial arts training;
• represent HAKI CLUB in a respectful and positive manner both inside and outside of the training hall.
11. TERMINATION:
HAKI CLUB, Sports and Health Organisation may terminate this Agreement at any time for any reason, including but not limited to the Member's violation of HAKI CLUB, Sports and Health Organisation rules and regulations or safety regulations by providing a written notice to the Member or his/her parent/guardian.
Upon cancellation, the Member or his/her parent/guardian will not be entitled to a refund of any membership fees already paid.
12. WAIVER AND RELEASE:
The Member and/or his/her parent/guardian acknowledges that participation in HAKI CLUB, Sports and Health Organisation activities involves a risk of injury, and hereby assumes all such risk. The Member and/or his/her parent/guardian agrees to release and waive any claims against HAKI CLUB, Sports and Health Organisation, its executive officers, directors, employees, agents, and affiliates for any injury, loss, or damage arising out of or in connection with the Member's participation in HAKI CLUB, Sports and Health Organisation activities.
13. GOVERNING LAW:
This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom, without giving effect to its conflicts of law principles.
14.ENTIRE AGREEMENT:
This Agreement constitutes the entire agreement between the parties and supersedes all prior negotiations, understandings, and agreements, whether oral or written, between the parties concerning the subject matter hereof.
